THE NATIONAL ENVIRONMENT APPELLATE AUTHORITY ACT, 1997


This Act provides for the establishment of a National Environment Appellate Authority to hear appeals with respect to restrictions of areas in which industries, operations or process or class of industries, operations and process it, shall be carried out subject to certain safeguards under the Environment (Protection) Act, 1986. In view of recent Judgement by Hon'ble Supreme Court in certain public interest litigation cases involving environmental issues, it was considered to set up an independent body for quick redressal of public grievances. Accordingly a National Environment Appellate Authority was constituted by Government of India to deal with petitions granting environmental clearances to develop projects under the provisions of the Environment (Protection) Act.,1986

SITING OF NEW INDUSTRIES

Guidelines have been evolved for siting New Industries prescribing the distance from sensitive areas and restricting certain industries within 1 km from specified water sources.

Government in G.O. Ms. No.213/E&F(EC-I) Dept. ECII/ dt . 30.3.89 has imposed restriction of certain highly polluting industries within 1km of specified water sources. The restriction has further been made stringent as 5km in respect following water sources as per G.O. Ms. No.127 E&F Dept(EC3)dt.8.5.98 read with G.O. Ms (ID) No, 223 E&F(EC3)Dept dt 2.9.98.
