IMPORTANT PROVISIONS OF THE AIR (PREVENTION AND CONTROL OF POLLUTION) ACT 1981 AS AMENDED IN 1987 .

This is an Act to provide for the prevention, control and abatement of air pollution, preservation of the quality of air and establishment of Boards.

-to plan a Comprehensive Programme for the prevention , control or abatement of air pollution

-to advise the State Government with respect to suitability of any premises or location of any industry which is likely to cause air pollution

-to collect and disseminate information relating to air pollution 

-to collaborate with the Central Board in organising the training and mass education programmes . 

-to lay down standards for emission of air pollutants Noise level into the atmosphere from industrial plants and automobiles or for the discharge of any air pollutants into the atmosphere from  any other source whatsoever not being a ship or an aircraft and for recognition/establishment of Board Laboratories.

Section 18 

Power to give directions by Central Government to Central Board, and Central Board and State Government to State Board 

Section 19

Entire State of Tamilnadu declared as Air Pollution Control Area. 

Section 20

Powers to give instructions for ensuring standards for emission from automobiles. 

Section 21 

Requires the industries to obtain the consent of the State Pollution Control Board to establish or operate any industrial plant in the Air Pollution control Area. 

Section 22 

Persons carrying on industry etc., not to allow emission of air pollutants in excess of the standards laid down by State Board. 

Section 22A 

Power of Board to make application to Court for restraining persons from causing air pollution. 

Section 23

Requires the industries to furnish information on the emission in excess of the standards laid down to the Board, District Collector, Revenue Divisional Officer, the Executive Authority of the Local Body and the nearest police station concerned. 

Section 24 & 25

Deals with power of entry, inspection and to obtain information 

Section 26 

Power to take samples of air or emissions and procedure to be followed in connection therewith. 

Section 31 

Provides for appeal against the orders of the Board. 

Section 31A

Empowers the Board to issue directions for closure, Prohibition or regulation of any industry operation or process or the stoppage or regulation of supply of electricity, water or any other service.

Maintenance of register regarding consent granted under Section 21 of the Air Act, the standards for emission laid down in the consent order issued to the industrial units and the consent register shall be open to inspection at all reasonable hours by any person interested or affected.
