HAZARDOUS WASTE (MANAGEMENT AND HANDLING) RULES,
1989 as amended in 2003


Rule 4 

Responsibility of occupier and operator of a facility for proper collection, reception and treatment of storage and disposal of hazardous wastes listed in sub – 1,2&3.

Rule 4 A

Duties of the occupier and operator of a facility

· To contain contaminants and prevent accidents and limit their consequences on human and the environment.

· To provide persons working on the site with the information, training and equipment necessary to ensure their safety.

Rule 5 

Grant of Authorisation for handling hazardous waste.

  • Hazardous wastes to be collected, treated, stored and disposed only in authorised facilities.
  • Application for authorisation to be made by occupier or an operator of a facility in Form-I
  • Application complete in all respects to be processed within 90 days.

Rule 6

Empowers the Board to cancel the authorisation in case of non-satisfactory functioning of the factory after opportunity to show cause. And after recording the reasons thereof.

Rule 7 

Occupiers must ensure safe packaging, labelling of hazardous wastes as per Motor Vehicle Act 1988

Rule 9

Requires the occupier to maintain records and to send an annual return on the hazardous waste handled

Rule 11 

Import of hazardous waste for dumping or disposal not permitted

Rule 12

· Import and export of hazardous wastes permitted as raw material for recycling and reuse.
· Ministry of Environment & Forests – Nodal Ministry to grant permission and deal with transboundary movement of hazardous wastes.
