NOTE ON BATTERIES (MANAGEMENT & HANDLING) RULES --2001

In order to regulate the collection, chsnnelisation and recycling of used lead acid batteries in the country, the Ministry of Env. & Forest has notified the final,. Rules entitled “Batteries (Management & Handling) Rules 2001” on 16.5.2001.

APPLICATION : The rules shall apply to every

Manufacture – a person or CEO of the company manufacturing lead acid batteries
Importer - a person who imports new lead acid batteries or components for sale.
Reconditioner – a person involved in repairing of lead acid batteries for selling the      same.
Recycler – an occupier who processes used lead acid batteries for recovering lead.
Registered recycler – a person registered with Ministry of Env. & Forest or an    agency designated by it for reprocessing used lead batteries .
Auctioneer – a person who auctions used lead acid batteries or
Bulk consumer – a consumer such as the Central or State Govt. Dept. of Railways,    defence , telecom, P&T, state Road Transport Undertakings, EB & other who    purchase batteries through central rate.

Salient features of the act :

The Rules make it mandatory for consumers to return used batteries and make    manufactures/ assemblers / reconditioners / importers responsible for collection of    used batteries and ensuring their onward transport to recyclers who are registered    with MOEF based on their possessing environmentally sound technology for    processing lead acid batteries. Manufactures are requested to set up collection    centres for collection of used batteries
COLLECTION CENTRES : could be sent up individually or jointly
Bulk Consumers: such as Central/State Govt. departments, State road transport    undertakings and Original Equipment Manufactures such as automobile manufactures    have been exclude from the obligation to collect. used batteries
Bulk consumers / auctioneers could auction used batteries to registered recyclers &    small scale manufactures can procure recycled lead from registered recyclers.
Dealers have been assigned responsibility for collection.
Importers & domestic manufactures have been placed on the same Footing as far as responsibility for collection is concerned.


Responsibilities of manufacture / importer/assembler / re-conditioner.

Ensure that used batteries are collected back as per the schedule against new    batteries sold (excluding bulk consumer & original equipment manufacturer ).
Ensure that used batteries collection back are of similar type & specification as the    new batteries.
File a ½ yearly return of their sales & buy back to the State Board in From-1 by 30/6    & 31/12 every year.
Setup collection centers individually or jointly.
Ensure that used batteries are sent to registered recyclers.
Ensure that necessary arrangements are made with dealers for safe transportation    from collection centers to the registered recyclers.
Ensure that no damage occurs during transportation.

Create public awareness through advertisement publication, posters with regard to the following:

Hazardous of lead
Responsibility of consumers to return used batteries at collection centers.
Address of dealers & collection centers.
Use international recycling sign on batteries.
By recycled lead from registered recyclers.
Inform the Board or MoEF in case of violation by the dealers.
